By using any Stevens & Stevens, LLC or Best Association® system, service, or data, you and your organization agree:
- To waive and release Stevens & Stevens, LLC, its owners, partners, managers, employees, contractors, and independent contractors and consultants, both in their individual and official/representative capacities, from all claims, demands, rights of action, or liabilities of any nature that I or my organization, company, corporation, heirs, or assignees may have for any liability, injury, loss, or damage based upon, arising out of, or in any way connected with the use and activities from or related to any systems, products or services associated with Stevens & Stevens, LLC, any Best Association systems, the Best Association website, or any related services or products, including, but not limited to, any and all such claims based upon any negligence on the part of the Released Parties. I further agree to indemnify and hold harmless the Released Parties from any and all claims, demands, rights of action, or liabilities of any nature that any person or organization may have against me, my organization, company, corporation, heirs, or assigns based upon, arising out of, or in any way connected with the use of any systems, products or services from or related to Stevens & Stevens, LLC, any Best Association systems, the Best Association website, or any associated services or products, including, but not limited to, any and all such claims based upon any negligence on the part of the Released Parties.
- That any and all data and information entered into the Best Association systems and related systems may be aggregated with other data and reported by Stevens & Stevens, LLC and its assignees.
- That Stevens & Stevens, LLC and its assignees may send you emails related to the Best Association® website and the Best Association® Index system.
- That Stevens & Stevens, LLC, its owners, partners, managers, employees, contractors, and independent contractors and consultants do not make any warranty of any kind as to the statistical validity or suitability of the data, systems, reports or charts. You acknowledge and agree that the data, systems, reports and charts should not be used for important decision making and do indemnify Stevens & Stevens, LLC, its owners, partners, managers, employees, contractors, and independent contractors and consultants from any claims resulting from the use of these data, systems, reports and charts.
- That Stevens & Stevens, LLC and its assignees may discontinue this service and delete the data, systems, reports and charts at any time.
- That any disputes shall be governed by and construed in accordance with the laws of Marion County, State of Indiana, United States of America, without reference to rules governing choice of laws.
- That Stevens & Stevens, LLC and its assignees may change these terms at any time without notice. Your continued participation shall constitute your acceptance of any such modifications.
- That you agree to the Stevens & Stevens, LLC and Best Association privacy policy, which Stevens & Stevens, LLC and its assignees may also change at any time without notice. Your continued participation shall constitute your acceptance of any such modifications.
